General provisions
§ 1.

  1. Privacy and cookie policy on the www.photocourse4u.com website (hereinafter referred to as: the “Policy”) was compiled and adopted by Openity Sp. z o.o. with the registered office at ul. Poznańska 99, 60-185 Skórzewo, KRS [National Court Register] number 0000953194, NIP [Tax ID number]: 7773386057.

  2. The terms used in the Policy shall mean the following:

    1. Website: www.photocourse4u.com website

    2. User: each entity using the publicly available Website;

    3. The data owner shall be – Openity Sp. z o.o. with the registered office at ul. Poznańska 99, 60-185 Skórzewo, KRS [National Court Register] number 0000953194, NIP [Tax ID number]: 7773386057,

    4. Cookies: text files, sent by the Website and stored on the User’s end device which the User uses when browsing websites. The files contain information necessary for correct Website operation. Cookies usually contain the domain name of the website from which they originate, the time they are stored on the end device, and the number;

  3. The purpose of the Policy includes in particular:

    1. to provide Users with the information regarding the use of Cookies by the Website, required by the provisions of law, including Telecommunications Law;

    2. to ensure protection of User privacy to the extent that complies with the standards and requirements laid down in the applicable legislation.

  4. The Owner shall limit the collection and use of information relating to Users, to the minimum necessary, in order to able to provide services to them.

  5. To get full access through the Website to the content and services offered by the Owner, it is advisable to accept the Policy principles.

  6. The below provisions of law shall apply:

    1. the Act of 16 July 2004 Telecommunications Law (Journal of Laws [Dz. U.] 2017, item 1907, as amended);

    2. the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws [Dz. U.] 2017, item 1219, as amended);

    3. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal 119 of 4.5.2016) along with Polish provisions on personal data protection.

§ 2.

  1. Data relating to Users shall be processed by the Owner in accordance with the law. The personal data of Users obtained by the Owner shall be processed based on the consent granted by the User or if other premise occurs, entitling to data processing, in line with the provisions of law, the Regulation in particular.

  2. The Owner shall exercise due care in order to protect the interests of data subjects and, in particular, ensure the data to be:

    1. lawfully processed, in a manner which is reliable and transparent for the Customers and other data subjects;

    2. collected for specific, explicit and legitimate purposes and not further processed in a manner incompatible with those purposes;

    3. adequate, appropriate and limited to what is necessary for the purposes for which the data is processed;

    4. correct and updated as necessary;

    5. stored in a form which permits the identification of the data subject, for a period not longer than it is necessary for the purposes for which the data is processed;

    6. processed in a manner ensuring adequate personal data security, including the protection against unauthorised or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organisational measures,

  3. The Owner applies adequate technical and organisational measures, ensuring personal data processing protection appropriate to the nature, extent, context and purposes of the processing and to the risk of violations of the rights or freedoms of natural persons.

  4. The Owner shall seek to regularly upgrade the IT, technical and organisational measures applied to protect such data, in particular the Owner shall ensure IT security updates allowing to protect against viruses, unauthorised access and other threats arising from the operation of the information system and telecommunications networks.

  5. To any User who has in any way made his or her data available to the Owner, the Owner shall ensure access to the data and the ability to exercise other rights by the data subjects in line with the applicable provisions of law, and the persons shall be entitled to the following:

    1. the right to withdraw personal data processing consent;

    2. the right to obtain information on their personal data;

    3. the right to control personal data processing, including the right to complement, update, rectify and erase the data;

    4. the right to object against the processing or to restrict data processing;

    5. the right to file a complaint to the supervisory authority and to utilise any other legal measures in order to protect their rights.

  6. The Owner may process the personal data in an automated manner, including by profiling, in accordance with the Regulation. In this case, the purposes of the Owner’s actions include marketing purposes or the need to customise messages sent to Users (which covers also tailoring the information to User needs or expectations). The User has the right to object against such processing of his/her data – the objection may be expressed by way of sending an email to the Owner’s address – kontakt@kursfoto.pl.

  7. A person having access to personal data shall process such data only subject to the Owner’s authorisation or under personal data processing agreement and only at the Owner’s request.

Cookies
§ 3.

  1. Cookies identify the User so that the content of the website the user uses can be tailored to his/her needs. By remembering the user preferences, it allows to tailor the content addressed to the user, including advertising. The Owner uses Cookies to ensure the right standard of the Website convenience and that the data collected is used only internally by the company to optimise operations.

  2. Cookies are used to:

    1. customise the Website content to User preferences,

    2. optimise Website use, in particular, by recognising the User device,

    3. compile statistics,

    4. maintain User session,

    5. provide User with advertising content.

  3. Cookies can be stored on the end device of the Website’s User.

  4. The data collected is used to monitor and verify how Users use the Website to improve the Website performance for more efficient and seamless navigation.

  5. Please note that in some cases, beyond the Owner’s control, the software installed by the User on his/her end device for web browsing (e.g., web browser) introduces the default storage of Cookies on the User’s end device. Users can make changes to the Cookie settings at any time. These settings may be changed at any time, like for example by blocking automatic Cookie setting or by notifying whenever they are added to the User’s end device. Detailed information regarding this topic is available in the software (web browser) settings and manuals.

  6. The User can, at any time, switch off or restore cookie saving option by changing web browser settings.

  7. Changing the settings constitutes an objection which may cause problems in the future when using the Website. Turning off the Cookie option completely does not mean that it will not be possible to view the content posted on the Website, except of those requiring logging to get access to.

  8. Failure to make changes to the settings means that the data will be stored on the User’s end device (using the Website will automatically add Cookies to the User’s end device).

  9. The data stored which are added to the User’s end device does not make any configuration changes to the User’s end device or software installed on such device.

  10. The Cookie information also applies to other similar technologies used within the Website.

Final provisions
§ 4.

  1. The Policy was adopted by way of the Owner’s resolution and shall enter into force as of 25.05.2018. Policy content may be changed in the same manner.

  2. Any deviation from the Policy shall be made in writing, otherwise, shall be deemed null and void.

  3. The law applicable to the Policy shall be the law of the Republic of Poland.

  4. To all matters not regulated in the Policy, relevant provisions of law shall apply.
